GENERAL CONDITIONS

These GENERAL CONDITIONS govern the relationship between MUSE Cosmetics Ltd, hereinafter referred to as "MUSE", on the one hand, and the Users of the websites and services located on the domain http://musecosmetics.bg (hereinafter referred to as Users), on the other hand.

By viewing www.musecosmetics.bg, each User automatically binds himself/herself to the terms and conditions described below.

This document contains information about the activities of MUSE and the general terms and conditions of use of the services provided by MUSE, and governs the relationship between us and each of our registered users. Confirmation of the General Terms and Conditions is a necessary and mandatory condition for the registration of each User and for the conclusion of the contract between him and "MUSE". By clicking on the virtual "Register" button, you are deemed to have read the General Terms and Conditions and to be bound by them.

Art. 1 The services provided by "MUSE" to the User constitute information society services within the meaning of the Electronic Commerce Act.

Art. 2 "MUSE" is an electronic store, available on the website www.musecosmetics.bg, through which Users have the opportunity to conclude contracts for the purchase and delivery of the goods offered by "MUSE".

Art. 3 (1) "MUSE" identifies the Users of the Site by storing log files on the server of www.musecosmetics.bg and the IP address of the User.

(2) MUSE is entitled to collect and use information about Users after they have registered. Personally identifiable information may include first name, last name, date of birth, gender, address, telephone number, and any other information that the person voluntarily provides upon registration. Information also includes any other information that the User enters, uses or provides when using the Services provided by "MUSE".

 Art. 4 (1) MUSE shall exercise due care and shall be responsible for the protection of the User's information made known to the User in connection with the registration - subject to these Terms and Conditions, except in cases of force majeure, accidental occurrence or malicious acts of third parties.

(2). In the registration form filled in by the User at registration, "MUSE" indicates the mandatory or voluntary nature of the provision of the data and the consequences of refusal to provide them. By agreeing to these General Terms and Conditions, the User agrees to the processing of his/her information in the manner provided for therein.

(3) The restrictions under par. 1 shall not apply in the event that an obligation arises for MUSE to provide the User's personal information to the relevant competent state authorities in accordance with applicable law.

Art. 5 (1) MUSE collects and uses the information referred to in Art. 3 for the purposes set out in these Terms and Conditions, as well as to offer new goods and/or services to the User (free or paid). The described purposes for which the information is used are not exhaustively listed and do not give rise to any obligations for MUSE.

(2) By accepting these Terms and Conditions, the User agrees to the processing of his/her personal data for the purposes of this contract and direct marketing.

Art. 6 (1) The user may register by filling in the relevant electronic registration form, available in real time (on-line) on the Internet on the MUSE website, agreeing to these Terms and Conditions and declaring that he/she is legally competent.

(2) By pressing the virtual button "Register", which has the power of a written confirmation of the Terms and Conditions, the User makes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, by which he declares that he is familiar with these Terms and Conditions, accepts them and undertakes to comply with them. By saving it on the appropriate medium in the server of "MUSE", by means of a generally accepted standard for conversion in a technical way making its reproduction possible, the electronic statement acquires the quality of an electronic document within the meaning of the cited law. "MUSE" may store in log files on its server the IP address of the User, as well as any other information necessary to identify him and reproduce his electronic statement of acceptance of the General Conditions in the event of a legal dispute. The text of these Terms and Conditions is available on the Internet on the MUSE website in a manner that allows its storage and reproduction.

(3) When completing the application for registration, the User is obliged to provide complete and correct data on identity (for natural persons), legal status (for legal entities) and other data required by the electronic form of "MUSE", as well as to update them within 7 (seven) days of their change. The User declares that he/she agrees to provide the personal data so required, whereby he/she guarantees that the data he/she provides in the registration process are true, complete and accurate and will update them promptly if the latter changes. In the event of providing false data, MUSE shall be entitled to terminate or suspend immediately and without notice the provision of the Services, as well as the maintenance of the User's registration.

Art. 7 (1) Upon registration, the User shall register with a unique username and password to access the services available through the MUSE website.

(2) The username with which the User registers does not give the User any rights other than the right to use the specific username within the MUSE e-shop.

(3) The registrant, as the representative of a legal entity, shall be required to enter his or her full name and address, or the name of the legal entity that he or she represents. By accepting the General Terms and Conditions, he warrants and confirms that he has a contractual relationship with the user company registered by him. In the event of entering incorrect or misleading information, the party forfeits the right to access the services on the MUSE website.

(4) The User shall take all reasonable care and measures to protect his password and shall not make his password available to third parties and shall immediately notify MUSE in the event of any unauthorized access or suspected unauthorized access. He bears the responsibility and risk for the protection of his password, as well as for any actions that are carried out by him or by a third party using his password.

Art. 8 (1) The user has the right to access on-line the services provided through the MUSE website, subject to the conditions and access requirements set by MUSE. In order to be able to use the services, the User must enter his/her username and password.

(2) The user has the right to access and correct on-line his personal data provided at registration.

Art. 9 (1) Users use the interface of the MUSE website to conclude contracts for the purchase and sale of the goods offered by MUSE in the e-shop.

(2) The contract for the purchase and sale of goods shall be deemed to have been concluded from the moment of its order by the User through the MUSE website.

Art. 10 (1) In order to place an order, the User must register in accordance with the terms and conditions described in these General Terms and Conditions, as well as log into the system by identifying with a username and password.

(2) After selecting one or more goods offered on the MUSE website, the User must add them to his list of goods to purchase ("basket", "cart").

(3) It is necessary for the User to provide details for delivery and to select the method and time of payment of the price, and then to confirm the order through the e-shop interface.

(4) When placing an order, the User receives an email confirmation that his order has been accepted.

Art. 11 (1) The prices of the products offered in the online shop are those indicated on the MUSE website at the time of ordering, except in cases of obvious error.

(2) Product prices are quoted in the currency indicated on the MUSE website and include VAT where applicable. Products are invoiced exclusively and exclusively in the currency indicated on the MUSE website.

(3) Invoices shall be issued only in the name of the person who placed the order.

Art. 12 "MUSE" reserves the right to change the prices of the products offered in the online store at any time and without notice, such changes will not affect orders already placed.

Art. 13 (1) "MUSE" may grant discounts for the products offered in the online store in accordance with Bulgarian legislation and rules set by "MUSE". The rules applicable to such discounts are available at the place where the discount is displayed. Discounts may be provided in various forms (e.g. promotions, loyalty discounts, provided individually, randomly or as a result of participation in a contest or customer survey).

(2) Different types of discounts cannot be combined when ordering and purchasing the same goods.

Art. 14 Where the User returns a product with the right to a refund for any reason, the price subject to refund shall be reduced by the value of the discount received and applied to the product, and only the amount actually paid shall be refundable.

Art. 15 (1) The user may pay the price of the ordered goods using one of the options listed on the website. At www.musecosmetics.bg it is possible to pay by cash on delivery, by credit or debit card and by instalment through TBI Bank.

(2) If the User chooses the option of delivery by courier and payment on delivery, he must pay the price of the ordered items together with the courier's delivery cost upon receipt of the goods.

Art. 16 If the User chooses a payment method involving a third party payment service provider, the User may be bound by the terms and conditions and/or fees of such third party.

Art. 17 MUSE shall not be liable if a payment method involving a third party payment service provider is not available or is otherwise not functioning due to reasons that cannot be attributed to MUSE.

Art. 18 (1) The delivery of the ordered goods shall be carried out by courier to the office or delivery address indicated by the User on the territory of the Republic of Bulgaria, or delivery address on the territory of the other 26 EU Member States.

Delivery is at the expense of the User, unless otherwise expressly stated on www.musecosmetics.bg.

(2) Before sending the ordered goods, "MUSE" has the right to contact the User at the telephone number indicated by him in order to clarify the details of the order and/or delivery.

(3) MUSE shall not be liable for non-fulfillment of an order in cases where the User has provided false, incomplete and/or inaccurate personal data, including where the User has provided an incomplete, inaccurate or fictitious address or telephone number.

Art. 19 Delivery shall be made within the time limits described in the section "Delivery". In exceptional circumstances, MUSE reserves the right to extend the delivery period, informing the User thereof in good time.

Art. 20 (1) Ordered goods shall be delivered against signature, with larger consignments (at the courier's discretion) being delivered to the entrance of the building.

(2) The consumer is obliged to inspect the goods at the time of delivery and to notify the courier immediately in case of any discrepancies, shortages and damage. If the Consumer fails to do so, the delivery shall be deemed to have been accepted without objection. 

Art. 21 (1) In the event of impossibility or difficulty of personal delivery to the addressee, the parcels shall be delivered as follows:

a) for a business address - to a person with a place of work at the address, noting the name of the person who received the parcel;

(b) for a home address, to a member of the household, noting the name of the person who received the package.

(2) In the event of inability to deliver the parcel, occurring through no fault of "MUSE" or the courier, the person making the delivery shall call the contact phone number provided by the User to be specified from which office of the courier the User can receive the delivery.

(3) If the User cannot be contacted, the distance sales contract is automatically cancelled and MUSE is released from its obligation to deliver the ordered goods.

Article 22 In the case of international deliveries, the rules for delivery and receipt of parcels of the relevant national postal service shall apply, as well as the relevant national legislation of the country in which the consignee of the goods is located.

Art. 23 MUSE reserves the right to change the available delivery and payment methods and/or the terms thereof at any time by posting the available delivery and payment methods on the Website without other notice.

Art. 24 (1) The User shall have the right to withdraw from the contract without giving any reason and without compensation or penalty within 14 days from the date of acceptance of the goods by the User or by a third party.

(2) In order to exercise his right under this clause, the User must notify MUSE in writing of his decision to cancel the contract, individualizing the goods he wishes to return by providing all details of the order and delivery made, including but not limited to: the content and value of the order, details of the person who made the order, details of the person who accepted the delivery and the date of delivery.

(3) The User is obliged to return the goods at his own expense, handing them over to MUSE or to a person authorized by the latter, within 14 days from the date on which the User has exercised his right of withdrawal.

(4) In the event that the User fails to comply with his obligation under the preceding paragraph without notifying MUSE of the delay and without providing a valid reason for the same, he shall be deemed to have withdrawn his statement of exercise of withdrawal.

Art. 25 (1) The consumer shall not have the right to withdraw from the contract in the event that the subject of the same are: products made to individual specifications or obviously customized; products that may deteriorate in quality or products with a short shelf life; products that cannot be returned for reasons of health or hygiene protection and that are printed after delivery.

(2) In the event that, upon receipt of the returned goods, they are found to have unsealed factory packaging (in the case of products that cannot be returned for health or hygiene reasons), MUSE will not be obliged to refund the price paid to the User.

Art. 26 MUSE shall refund the price paid by the User for the returned goods to the bank account specified by the User within 30 days of receipt of the returned goods. The costs of supplies paid by "MUSE" will be deducted from the amount .

Art. 27 In the event that the Consumer discovers a manifest non-conformity of the goods with the contract of sale, he shall have full rights to claim in accordance with the provisions of the Consumer Protection Act.

Art. 28 MUSE shall have the right to terminate the contract unilaterally at its own discretion, without notice, in the event that it finds that the services provided are being used in violation of these General Terms and Conditions, the legislation in the Republic of Bulgaria and generally accepted moral standards.

Art. 29 (1) The intellectual property rights in all materials and resources located on the MUSE website (including the available databases) are protected by the Copyright and Related Rights Act, belong to MUSE or to the duly designated person who has assigned the right of use to MUSE, and may not be used in violation of applicable law.

(2) The User's right of access shall not include the right to use, copy or reproduce information constituting an intellectual property object, unless it concerns an insignificant amount of information intended for personal use, provided that the legitimate interests of the authors or other holders of intellectual property rights are not unduly harmed and in the event that the copying or reproduction is carried out for non-commercial purposes.

(3) In the event of copying or reproduction of information outside of what is permissible according to the preceding paragraph, as well as in the event of any other infringement of intellectual property rights on MUSE resources, MUSE shall also be entitled to claim compensation for direct and indirect damages in full.

(4) The User undertakes, when using the access to services offered by MUSE: to comply with Bulgarian legislation, these General Terms and Conditions, Internet ethics, rules of morality and good manners; not to harm the good name of another and not to call for a violent change of the constitutionally established order, to commit a crime, to violence against the person or to incite racial, national, ethnic or religious hatred, not to preach fascist or other anti-democratic ideology, not to violate other people's property or moral rights, including intellectual property rights; to immediately notify "MUSE" of any case of committed or detected violation; not to interfere with the proper functioning of the system, including, but not limited to, not to frustrate the identification procedure of another User, not to exercise access beyond that granted, not to impair or impede the availability, reliability or quality of the access granted, and not to use it in a way that causes its use to be denied; not to extract, by technical means or in a technical way, information resources or parts of information resources belonging to the databases located on the MUSE website and thus

(5) Except where expressly agreed, the User may not reproduce, modify, delete, publish, distribute or otherwise disclose the information resources published on the MUSE website.

Art. 30 (1) "MUSE" undertakes to take due care to ensure that the User is able to have normal access to the services provided.

(2) MUSE has the right to deactivate or delete the username and password for access to the User's profile in the event that the latter infringes the intellectual property rights of MUSE on the intellectual property elements contained on its website.

(3) "MUSE" reserves the right to suspend access to the services provided upon notice in the User's profile. "MUSE" has the right, but not the obligation, at its sole discretion, to delete information resources and materials posted on its site.

Art. 31 (1) In addition to the cases provided for in these General Terms and Conditions, the contract between the parties shall also be terminated if MUSE ceases to operate or ceases to maintain its website.

(2) The user has the right to stop using the services provided by MUSE at any time at his own discretion.

(3). Upon termination of the contract, "MUSE" shall deactivate the User's account and delete the password to access it. 

Art. 32 Except as provided above, either party may terminate this Contract by giving one week's notice to the other party in the event of default under the Contract.

Art. 33 The written form of the contract shall be deemed to have been complied with by sending a message by electronic mail (e-mail), pressing an electronic button on a page with content that is filled in or selected by the User or ticking a box (check box) on the website, etc., as long as the statement is recorded technically in a way that makes it possible to reproduce it.

Art. 34 The parties declare that if any clause(s) of these General Terms and Conditions should prove to be invalid, this shall not invalidate the whole contract or any other part thereof. The invalid clause will be superseded by mandatory rules of law or established practice.

Art. 35 (1) "MUSE" undertakes to notify Users of any amendment to these General Terms and Conditions within 7 days of the occurrence of such circumstance to the email address provided by the User.

(2) Where the User does not agree with the amendments to the General Terms and Conditions, the User shall have the right to withdraw from the contract without giving any reason and without being liable to compensation or penalty. In order to exercise this right, the User must notify MUSE within one month of receipt of the notice referred to in the preceding paragraph.

(3) In the event that the User does not exercise his right to withdraw from the contract in accordance with the procedure set out in these General Terms and Conditions, the amendment shall be deemed to have been accepted by the User without objection.

Art. 36 The provisions of the current legislation of the Republic of Bulgaria shall apply to all matters not covered by these General Terms and Conditions.
